How does mediation work?
Mediation is another form of dispute resolution, like collaborative divorce. A mediator is a neutral 3rd party hired by the parties to essentially referee their case. However, unlike a true referee, the mediator does not make any decisions. Mediations may take place between the parties and the mediator only, or the parties may each hire their own attorneys. The mediator can be an attorney or someone else who has been trained as a mediator. However, the mediator cannot provide the parties with legal advice, even if the mediator is an attorney. The parties may enter into a Separation Agreement based on what they have negotiated in mediation. That Agreement should be drafted by an attorney, and each party should seek legal counsel before signing any Agreement. |
